Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy applies only to “consumer health data” as that term is defined by the Washington My Health My Data Act (RCW 19.373) and the Nevada consumer health data law (NRS 603A.400 to 603A.565). It is a separate document from our general Privacy Policy and governs only the categories of data described below.

Personal Injury Counsel is a lead generation service. We are not a law firm, a health care provider, or a HIPAA-covered entity, and we do not provide legal advice, medical advice, or health care services.

1. Categories of consumer health data we collect, and how it is used

When you complete our online questionnaire, we may collect:

• Injury status — whether you indicate you were injured in a motor vehicle accident.
• Treatment status — whether you indicate you have received medical treatment, are receiving or intend to seek treatment, or have not been treated.
• Health details you choose to volunteer — any information about your physical condition that you type into the free-text description of what happened. We do not ask you to provide this, and you should not include more detail than you wish to share.

We use this data for one purpose: to evaluate whether your inquiry may be eligible for a free case review, and to transmit your inquiry to a participating recipient that handles matters of that type. We do not profile you for anything unrelated to that request. Consumer health data is never included in what we send to advertising platforms — Section 7 explains that in full, including one limitation you should be aware of.

2. Categories of sources

We collect consumer health data from a single source: directly from you, through the questionnaire you complete on our website. We do not purchase consumer health data, and we do not derive or infer health data from other sources such as browsing behavior, purchases, or location.

3. Categories of consumer health data we share

We share the same categories described in Section 1 — injury status, treatment status, and any health details you volunteer in your description — together with the contact and incident information you provide.

4. Categories of third parties and affiliates with whom we share consumer health data

• Participating law firms and legal marketing companies who may contact you about a free case review. A legal marketing company may in turn provide your inquiry to an attorney or to another company in its network — see Section 10. The current list is published at Participating Legal Partners.
• Service providers acting on our behalf, under contract and limited to our instructions: website and infrastructure hosting; lead-verification and consent-certification providers; and communication platforms used to contact you.

Specific affiliates: we operate other accident-claim websites under common ownership. Your consumer health data is held in shared infrastructure and is recorded against the brand you used, and it is used only to fulfil the request you made here. We also maintain a do-not-contact and fraud suppression list that applies across our brands, so that a request to stop contacting you is honoured everywhere rather than only on one site. We do not use consumer health data collected here to market our other brands to you.

5. Purposes of collecting, using, and sharing consumer health data

To determine whether your inquiry may qualify for a free case review; to transmit your inquiry to participating law firms so they can contact you about that review; and to keep records necessary to verify consent and comply with legal obligations. We do not sell or share consumer health data for any purpose you have not requested.

6. How consumer health data is processed

Your answers are evaluated automatically against the criteria participating law firms have specified — for example, the type of accident and whether you already have legal representation. Data is stored in access-controlled systems, and access is restricted to personnel and processors who need it for the purposes described above. We maintain administrative, technical, and physical safeguards appropriate to the nature and volume of the data.

7. Advertising measurement, and what it can imply

We do not permit third parties to collect consumer health data over time or across different websites or online services through our website.

The advertising platforms on which we buy media — such as Meta and Google — are not among the recipients described in Section 4. They never receive your injury status, treatment status, or any health details. We do send them measurements so we can understand which advertising works; those measurements contain no health information, are sent from our servers rather than from your browser, and exclude every questionnaire answer.

One limitation of that design is worth stating plainly: some measurements are sent only for inquiries that meet a recipient's criteria. So while a measurement itself contains no health information, the fact that one was sent for you can imply something about the answers you gave, including whether you reported an injury. Measuring advertising at all requires this, and we keep it to the minimum described here.

Consent-certification technology records your interaction with the form itself in order to document the consent you provided; that recording is used solely for compliance verification and is not used for advertising.

8. Your rights, and how to exercise them

If you are a Washington or Nevada consumer, you have the right to:

• Confirm whether we collect, share, or sell your consumer health data, and access that data;
• Obtain a list of the third parties and affiliates with whom we have shared or sold it, including contact information for those parties;
• Withdraw consent to our collection and sharing of your consumer health data;
• Request deletion of your consumer health data.

Submit any of these requests through our Do Not Sell or Share My Personal Information form, or by email to [email protected]. You will not be discriminated against for exercising these rights, and exercising them will not affect the quality or price of anything we offer.

We will confirm receipt and respond within the timeframes required by applicable law. If we deny a request, you may appeal by replying to our decision or emailing [email protected] with the word “Appeal” in the subject line. We will respond to an appeal in writing, and if the appeal is denied we will provide a method for you to contact your state Attorney General.

9. Reviewing and correcting your consumer health data

You may request to review the consumer health data we hold about you, and to request corrections, using the form linked above (select “Know / access my personal information” or “Correct my personal information”).

10. Who receives your inquiry, and what they may do with it

When you request a free case review, we transmit your inquiry — including the consumer health data described in Section 1 — to a participating recipient, and we receive compensation in connection with that transmission. That is the service you are requesting, and it is the only purpose for which we transmit this data.

Recipients are not all law firms. Some are law firms that may represent you directly. Others are legal marketing companies that work with a network of attorneys; a company of that kind may contact you itself, and may in turn provide your inquiry to an attorney or to another company in its network. Once your inquiry reaches a recipient, that company handles your information under its own privacy policy, not this one, and we do not control what it does with it. We do not transmit your consumer health data to anyone for purposes unrelated to your request for a case review. See Section 7 for how this interacts with our advertising measurement.

You can withdraw your consent, or ask us to delete your consumer health data, at any time using the form linked in Section 8.

11. Changes to this policy

If we make a material change to this policy — including collecting a new category of consumer health data, sharing it with a new category of recipient, or using it for a new purpose — we will update this page and its effective date before the change takes effect, and, where the law requires it, we will obtain your affirmative consent before collecting, using, or sharing consumer health data under the changed practice.
